Acceptance of Terms
These Terms of Service (“Terms”) form a contract between you and Mashric Inc. (“Mashric”, “we”, “us”) and govern your use of the Mashric mobile application, our website, and related services (collectively, the “Service”). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service and at least the age of majority in your province to place a paid order. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.
Your Account
You are responsible for keeping your sign-in credentials confidential and for all activity that occurs through your account. Notify us promptly at support@mashric.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, our policies, or applicable law.
Orders and Pricing
Orders are an offer by you to purchase the selected items at the prices and fees shown at checkout. We may decline, cancel, or refund any order — including for reasons of availability, suspected fraud, pricing errors, or operational constraints — before, during, or after acceptance. All prices are in Canadian dollars and include applicable taxes as displayed at checkout. Item descriptions, photos, and availability may vary by store and time of day. Menu prices and items shown in the app may be updated without notice.
Payment
Payments are processed by Stripe. By placing an order, you authorize us (through Stripe) to charge your selected payment method for the total shown at checkout, including the item price, applicable taxes (HST at the Ontario rate of 13%), any delivery fee, and any tip you choose to add. You represent that you are authorized to use the payment method. If a payment is declined or reversed, we may cancel the order and disable affected account features until the issue is resolved.
Pickup and Delivery
For pickup orders, items are prepared for collection at the store you selected. You are responsible for picking up your order within the time window shown in the app. Orders not picked up within a reasonable time may be discarded for food-safety reasons; refunds in those cases are at our discretion.
For delivery orders, we (or a third-party delivery partner) will deliver to the address you provide. You must ensure the address is accurate and that someone is available to receive the order. Estimated delivery times are not guaranteed.
Cancellations and Refunds
Cancellation, refund, and dispute handling are governed by our Refund and Order Policy, which is incorporated into these Terms by reference. By placing an order, you accept the terms of that policy as part of these Terms. In summary: you can cancel an order from the app for a full automatic refund while it is in the Confirmed status; once preparation has started, cancellation is allowed but no refund is issued. Refunds are returned to the original payment method through Stripe and typically post within 5–10 business days.
Allergen Disclaimer
Our food is prepared in shared kitchens that handle common allergens including peanuts, tree nuts, sesame, milk, eggs, fish, crustaceans, molluscs, soy, wheat, sulphites, and mustard. Cross-contact is possible. We cannot guarantee that any item is free from a specific allergen. If you have a food allergy, sensitivity, or specific dietary requirement, you must contact the store directly before ordering. By placing an order, you accept this risk and release Mashric Inc. from liability for allergic reactions resulting from undisclosed allergens or cross-contact, except where prohibited by law.
User Conduct
You agree not to: (a) misuse the Service, including attempting to access another user’s account or data; (b) place orders fraudulently or with payment methods you are not authorized to use; (c) harass our staff or third-party delivery personnel; (d) reverse engineer, decompile, or extract source code from the Service; (e) use the Service to violate any applicable law.
Intellectual Property
All content in the Service — including the Mashric name and logo, app design, menu photography, and software — is owned by Mashric Inc. or our licensors and is protected by Canadian and international intellectual property laws. We grant you a personal, non-exclusive, revocable licence to use the Service for ordering from Mashric stores. You may not copy, distribute, or create derivative works without our written consent.
Third-Party Services
The Service relies on third-party providers, including Stripe (payments), Supabase (cloud backend and authentication), Google Sign-In (optional account authentication via Supabase), Google Maps Platform (geocoding and maps), Firebase Cloud Messaging (push notifications only — we do not use Firebase Authentication or Analytics), Twilio (SMS one-time codes, via Supabase), Resend (transactional email), and any third-party delivery partner. Your use of features powered by those providers is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Mashric Inc. disclaims all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
To the maximum extent permitted by law, Mashric Inc., its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of CAD $100 or the total amounts you paid us in the six months before the event giving rise to the claim. Nothing in these Terms limits any non-excludable rights you have under Ontario or federal consumer-protection legislation.
Indemnification
You agree to indemnify and hold harmless Mashric Inc. from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.
Termination
You may stop using the Service at any time and may delete your account from within the app (Profile → Delete Account). We may suspend or terminate your access to the Service at any time, with or without notice, for any reason permitted by law — including violation of these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations, governing law, dispute resolution) will continue to apply.
Governing Law
These Terms and any dispute relating to the Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.
Dispute Resolution
Before filing a formal complaint, please contact us at support@mashric.com so we can try to resolve the issue informally. If the dispute is not resolved within 30 days, you and Mashric Inc. agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada, for any remaining dispute, except that either party may seek injunctive relief in any competent court.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, for material changes, notify you in the app or by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
